After more than two years of uncertainty, a Lafayette County Circuit Court Judge has rendered a decision that Jimmie "Jay" Lee, a former student at the University of Mississippi, is to be legally considered deceased. According to an Action News 5 report, the declaration comes as a result of Lee having undergone a "catastrophic event that exposed him to imminent peril or danger reasonably expected to result in the loss of life." The court concluded that the continued absence of Mr. Lee "cannot be satisfactorily explained" despite a diligent search.
Lee's case has been a point of continuous attention ever since his disappearance on July 8, 2022, when he was last seen at an apartment complex in Oxford, Mississippi. As cited by Local Memphis, his absence sparked fear particularly within the college town's LGBTQ community, where he was a well-known figure. The legal decision to declare Lee dead will allow for the issuance of a death certificate to his family.
Sheldon "Timothy" Herrington Jr., also a former student at the University of Mississippi, has been charged with Lee's murder. Despite the charges, Herrington has maintained his innocence throughout the proceedings. In 2023, Herrington was indicted on capital murder charges and currently awaits trial. Herrington had been arrested two weeks following Lee's disappearance and subsequently released on bond, with conditions including surrendering his passport and wearing an ankle monitor, an agreement detailed in the reporting by Local Memphis.
The news of Lee's official declaration of death provides a grievous form of closure to a community that had hoped to eventually find him alive. The WREG report mentions that multiple law enforcement agencies, friends, and family members were involved in the extensive search that followed his disappearance. Despite these efforts, Lee has not been found, leading ultimately to the court's order for the State of Mississippi to issue a certificate of death, based on documents filed on Oct. 15.
