
Patrick Dwayne Murphy, a 52-year-old from Henryetta, Oklahoma, was resentenced to life imprisonment for a 1999 murder in Indian country. This decision follows his conviction in August 2021, according to the United States Attorney’s Office for the Eastern District of Oklahoma. The case involves a violent crime that resulted in one death.
Investigations by the McIntosh County Sheriff’s Department, the Oklahoma State Bureau of Investigation, and the Federal Bureau of Investigation led to a case involving an attack, stabbing, and mutilation of a victim in McIntosh County within the Muscogee (Creek) Nation Reservation. The crime has raised concerns about jurisdictional issues in Indian country, as reported by the United States Attorney’s Office.
In May 2024, the Tenth Circuit Court of Appeals vacated the kidnapping convictions in the case of Murphy, who had originally been convicted of second-degree murder, kidnapping, and kidnapping resulting in death. Following this, Chief U.S. District Judge Ronald A. White oversaw a resentencing for the second-degree murder charge, reaffirming Murphy’s life sentence without the possibility of parole. Assistant U.S. Attorney Jarrod Leaman has handled the case through its lengthy legal process. Murphy will remain in U.S. Marshals custody until he is transferred to a Bureau of Prisons facility, as stated by the United States Attorney’s Office.
