
The future of Jerome 'Jerry' Cox hangs in the balance as Cobb County jurors continue to deliberate on a case that rocked the Kennesaw community in December 2023. Charged with driving under the influence and the subsequent death of 17-year-old Olivia Pugh, the trial reached a standstill Thursday with the jury at an impasse. A report by Atlanta News First stated that, after six hours of deliberation, the 12-person jury struggled to reach a consensus, prompting the court to adjourn until Friday morning.
Arguments in the case leaned heavily on the details of the tragic incident, which occurred when Cox was driving home from a Christmas party. Prosecutors claim Cox, then 68, ran his vehicle through a crosswalk on Ben King Road, hitting the Harrison High School honor student. While the defense has acknowledged Cox's consumption of alcohol, attorney Kim Frye argued there is no official proof of impairment, stating in the closing arguments, "You are permitted to drink alcohol and drive as long as you are not impaired," a detail highlighted in FOX 5 Atlanta's coverage.
Prosecutor Nolan Slifko focused on the presence of open containers in Cox's vehicle, suggesting an attempt to conceal them, and spotlighted the gravity of Cox's actions leading to Pugh's death. Conversely, Frye highlighted that a GMC vehicle's computer failed to detect Pugh and played down the evidence of impairment based on police reports of alcohol odor and admission. According to the defense, the existing body cam footage does not provide definitive evidence of Cox's impairment, as Frye told Atlanta News First.
