As stated in the GBI report, when officers tried to apprehend McVay, he attempted to flee and did not comply with their commands. An initial attempt to subdue McVay with a Taser proved unsuccessful, and as he continued to ignore commands, he reportedly charged toward the officers with a knife in his hand. In response, the officers discharged their firearms, striking McVay.

Despite the emergency personnel's efforts to save his life at the scene, McVay was pronounced dead after being transported to a local hospital. The body has been scheduled for an autopsy by the Fulton County Medical Examiner's Office, providing an account of the events leading to McVay's death in grave detail.

The GBI's independent investigation into this incident is ongoing, and the completed case file will eventually be handed over to the Fulton County District Attorney's Office for review.
