
The seat left empty on the Arizona Supreme Court by the retirement of Justice Robert Brutinel is nearing a decision on its new occupant. Governor Katie Hobbs is currently sifting through a roster of five potential candidates as the clock ticks on her 60-day window to fill the vacancy. According to a release by Fox 10 Phoenix, the shortlist comprises two judges from the Arizona Court of Appeals and three attorneys with substantial legal backgrounds within the state.
With the responsibility to appoint a justice to the state's highest court having been passed to her, Governor Hobbs' decision will add a new layer to the bench's composition, currently made up of justices appointed by former governors. As reported by 12 News, the Commission on Appellate Court Appointments' recommendations include Maria Elena Cruz and Andrew M. Jacobs, judges from the Arizona Court of Appeals; Nicole C. Davis, from the Department of Economic Security; Regina L. Nassen, from the City of Tucson; and Alexander W. Samuels, from the Arizona Attorney General's Office.
The Arizona Supreme Court operates with a six-year term cycle for its justices, including the selection of a Chief Justice for a five-year term. While Governor Katie Hobbs deliberates on her choice from the five candidates, if no decision emerges within the designated two-month period, the task of appointment will be deferred to the Chief Justice of the Arizona Supreme Court, as stated by Fox 10 Phoenix.
It is worth noting that among the nominees, Andrew M. Jacobs, already named to the Arizona Court of Appeals by Governor Hobbs in 2023, presents both a familiar and somewhat politically aligned option for the governor.
