In a case that has disturbed the community of Hanalei, 43-year-old Michael John Sears has been indicted on multiple serious charges including Murder in the Second Degree, Arson in the First Degree, and Abuse of a Corpse, Kauai County Press Releases reports. The allegations assert that on January 12, 2024, Sears played a direct role in the death of Paul Nicolas, and subsequently set Nicolas' property on fire without consent, causing extensive damage estimated to be upwards of $20,000.
Events took a grim turn in the early hours of that fateful January day last year when firefighters were summoned to Anahola Beach Park at around 3:00 a.m.; they were met with the distressing sight of a vehicle in flames, it wasn't until the fire was doused and law enforcement arrived to inspect the scene that the charred remains of an individual, later identified as Paul Nicolas, were discovered inside what was left of the vehicle with a forensic examination revealing that the victim had been shot multiple times before the apparent arson took place.
The investigation, headed by Kauai Police Department Detective Lucas Hamberg, led to Sears who has not seen freedom since February 2, 2024, after being held at Kauai Community Correctional Center on unrelated drug charges, and his bail is now set at a steep two million dollars in light of the recent indictment as per the prosecutor's office.
"The Indictment alleges that Sears intentionally or knowingly treated a human corpse in a way that would outrage ordinary family sensibilities," stated Prosecuting Attorney Rebecca Like, addressing the severity of the accusations against the Hanalei man; however, it's imperative to remember the charges pressed against Sears he remains innocent until proven guilty in a court of law, as reported by Kauai County Press Release.
