The Hawaiʻi Department of Health has reached into its regulatory toolbox to deal a financial slap to Hawaii American Water. On account of discharging effluent exceeding permitted limits, Hawaii American Water has been hit with a Notice of Violation and Order (NOVO). According to an official DOH release, the transgressions spanned from August 2022 to April 2024 with a tally of 14 occurrences where ammonia nitrogen levels surpassed what's legal under their current permit.

The NOVO issued requires Hawaii American Water to fork over $47,750 and mandates corrective measures to ensure this doesn't become a recurring issue. It's reported that, the company also stumbled in its obligations to submit written reports regarding noncompliance on two separate instances. Stakes are high with environmental compliance as penalties for failure to adhere can reach up to $60,000 per day, for each violation.

Deputy Director of the Environmental Health Administration at DOH, Kathleen Ho, highlighted the environmental threats posed by such negligence. "Ammonia is derived from the breakdown of proteins and amino acids in wastewater. High concentrations of ammonia can have toxic effects on aquatic organisms and contributes to excess nutrients in the water," she stated. Ho's emphasis on the matter drives home the point that Hawaiian waters aren't just for show – they're a vital habitat that needs safeguarding.

Protecting both public health and environmental sanctity is the duty of the DOH Clean Water Branch. Their mantra is straightforward: no discharge that messes with water quality, keeping Hawaii's waters both fishable and swimmable. The tough stance taken on Hawaii American Water is a clear signal that any wastewater system operator, be it governmental, private, or any other form – has to fall in line, or face the music.
