Ohio House Democrats are making strides to align state laws with the voters' demands for reproductive freedom. State Reps. Anita Somani (D-Dublin) and Desiree Tims (D-Dayton) have introduced the Reproductive Care Act, legislation seeking to repeal numerous restrictive abortion laws that are purportedly outdated and obstructive.

The proposed act, once known as House Bill 343 during the 135th General Assembly, responded to the state's constitutional amendment passed in 2023, which protected the right to reproductive care. “This bill repeals an assortment of archaic laws in our state that do not improve outcomes or access to care," explained Rep. Somani in a statement obtained by the Ohio House of Representatives. Among the laws targeted for repeal are those imposing medically superfluous procedures and hospital transfer agreements – the so-called TRAP (Targeted Regulation of Abortion Providers) laws.

The bill isn’t just about repealing. It also seeks to establish new protections regarding data privacy, nondiscrimination, and civil and criminal safeguards for those providing evidence-based care. These updates aim to enhance the healthcare environment for patients and practitioners in Ohio, where access to reproductive services remains contentious.

"The Reproductive Care Act is a critical step forward in ensuring that Ohioans have access to the reproductive healthcare they deserve, free from unnecessary restrictions," Rep. Tims stated, according to the Ohio House of Representatives. The motivation is clear: the bill sponsors believe honoring the will of the electorate, who demanded a constitution that respects reproductive rights, is paramount to reforming healthcare legislation.

The Reproductive Care Act currently awaits a new bill number and committee assignment before it can proceed through the Ohio legislative process. Advocates for reproductive rights are hopeful that the bill’s passage will signal a tide of change for Ohio, ensuring accessible and less restrictive abortion care that aligns with constitutional amendments advocating reproductive freedom.
