A Maricopa County Superior Court judge ruled that Arizona's 15-week abortion ban is unconstitutional. The decision aligns with Prop 139, which Arizona voters approved, establishing abortion rights up to fetal viability in the state’s constitution, according to FOX 10 Phoenix.
After the U.S. Supreme Court overturned Roe v. Wade, Arizona faced legal challenges over abortion laws. A court ruling struck down the state's 15-week ban after a lawsuit by two OB-GYNs and Planned Parenthood’s Arizona chapter. The decision allows abortions up to fetal viability (22–24 weeks) and blocks proposed legislation that sought further restrictions, as reported by FOX 10 Phoenix.
Reproductive rights advocates gathered at the capitol on Wednesday following a ruling that blocks the state from enforcing restrictive abortion laws. ACLU attorney Rebecca Chan stated, "Arizonans made it crystal clear that reproductive freedom is a core value in their state by passing Prop 139 in November, establishing a fundamental constitutional right to abortion," as stated by 12 News.
