
A class action lawsuit has been lodged against the City of Las Vegas, alleging that its marshals have made "unlawful arrests" outside of their jurisdiction. The legal action, initiated in the US District Court on Thursday, puts the spotlight on the conduct of city marshals accused of conducting traffic stops, detaining, and arresting people illegally on roads beyond their assigned boundaries. According to the complaint filed by attorney Adam Breeden, obtained by FOX5, this alleged pattern of behavior represents a "systemic pattern of unconstitutional and unlawful conduct."
The suit originates from an incident on January 9, involving plaintiff Derek Myers who was stopped by city marshals on I-11 near Craig Road. Claims detailed in the lawsuit include Myers being searched without consent or a warrant, subjected to a "faulty" DUI test, and was subsequently arrested and held for 17 hours. No criminal charges have since been filed against Myers. The lawsuit asserts that Myers is just one among potentially thousands impacted by what is described as "a rogue law enforcement agency brazenly operating outside its legal authority" to "repeatedly and willfully" overstep their jurisdiction. News of the legal challenge seeking over $1 million in damages was also reported by News 3.
The legal ramifications of such actions include battery, false arrest, and the violation of the 4th and 14th Amendment rights, which cover unlawful search and seizure, as well as false imprisonment. These stark accusations portray city marshals as agents of zeal, operating with impunity on the fringes of their lawful reach and, in doing so, allegedly infringing upon the constitutional safeguards of the citizenry.
Meanwhile, the Las Vegas Police Protective Association has, to date, not issued a comment on the matter, according to an outreach effort reported by News 3. The lawsuit not only aims to secure monetary damages but also to obtain an injunction to halt such practices forthwith and to officially certify the class action status to encompass all affected individuals.
