Attorney General Letitia James stated, "This is a monumental victory for the rule of law, for reproductive freedom, and for every patient who has been harassed, intimidated, or blocked from accessing the health care they need." The group’s actions violated the federal Freedom of Access to Clinic Entrances Act and the New York Clinic Access Act, according to the Office of the New York State Attorney General.
U.S. District Court Judge Kenneth M. Karas ruled after Red Rose Rescue members were found trespassing, refusing to leave, and causing delays for patients seeking care. The ruling upholds federal and state protections for patients and healthcare providers against obstruction or threats when accessing or delivering reproductive health services, as reported by the Office of the New York State Attorney General.
Attorney General James announced that further proceedings will be scheduled to address the unlawful conduct of Red Rose Rescue. She reaffirmed that "Abortion is health care" and stated her office will continue to enforce laws protecting reproductive care facilities and their clients. James encouraged individuals who believe their rights have been violated to contact the Civil Rights Bureau with complaints or concerns.
