On September 6, 2023, a 911 call reported suspicious activity related to a burglary. An Onondaga County Sheriff's Office deputy arrived to find two cars in a parking lot. One car fled, while the deputy blocked the other car, which contained Apet and Mo. When the driver attempted to flee, the deputy fired three shots into the vehicle. The car was later found in Syracuse, and Apet was declared dead at the scene. Mo died from his injuries in the hospital, as reported by the Office of the New York State Attorney General.

The Office of Special Investigation investigation into the deputy's use of force included home security footage, witness interviews, and expert analysis on shooting reconstruction and use of force. The evidence showed that the vehicle, whose occupants were suspected of involvement in an earlier burglary, was driving toward the deputy. The Office of the New York State Attorney General stated, "A car whose occupants were suspected of involvement in an earlier burglary was driving toward the deputy, who was standing in or near its path." The Office of Special Investigation recommended that officers be equipped with body-worn and vehicle dashboard cameras to help with future investigations.
