
The legal case regarding the Arizona Abortion Access Act Initiative has reached a new development. On August 14, 2024, the Arizona Supreme Court ruled that the Legislative Council had fulfilled its legal duty to provide voters with a fair description of the ballot proposal, according to the Arizona Supreme Court.
The Arizona Supreme Court, in an opinion written by Justice Kathryn King, supported the Council's decision to use the term "unborn human being" when referencing existing statutes. Proponents of the initiative had filed a lawsuit, arguing that this wording was biased and preferred the term "fetus." However, the Court determined that "unborn human being" accurately reflects Arizona's current law, and changing it would unfairly benefit the initiative.
The Arizona Supreme Court upheld the difference between the current statute and a proposed initiative, stating that the changes reflect the policy choices made by elected officials. The Court determined that the Council met the requirements for impartiality in providing clear and unbiased information to voters. Chief Justice Ann Scott Timmer, joined by Justice James Beene, dissented, creating a split within the Court.
