
A recent DUI conviction has brought the reality of impaired driving back into the public eye, as Knoxville's District Attorney Office announced the outcome of a case involving a driver found asleep at the wheel. Girish Dhirubhai Desai, 60, faced judgement for his actions on a quiet neighborhood street, resulting in a guilty verdict for Driving Under the Influence, according to the District Attorney's Office.
Detailing the events leading up to the arrest, prosecutors stated that on September 7, 2023, officers responded to calls about a white Toyota Tundra driving erratically. Desai was found in the vehicle, which was left running in the middle of the street, officers initiated the encounter by waking Desai who displayed clear signs of intoxication, including bloodshot eyes and difficulty managing simple tasks like turning off the vehicle's headlights. Despite his refusal for a blood alcohol test, and the defense’s claims of a diabetic episode, jurors took less than twenty minutes to come back with a guilty verdict.
Emphasizing the dangers of DUI, District Attorney Charme Allen stressed the importance of prosecuting such cases, "You cannot avoid responsibility by refusing to submit to a blood draw. If you were intoxicated, we will take you to trial and seek a conviction," as mentioned on the District Attorney's Office website. The Class A Misdemeanor for DUI can result in close to a year in jail, but for a first offense, the minimum is forty-eight hours along with DUI School and a license revocation for one year.
Desai received a $1,000 fine from the jury, and faces possible enhanced sentencing due to past refusals for sobriety testing and ignition interlock violations while awaiting trial in this incident.
