
Carlos Manuel da Silva Santos, the entrepreneur behind San Diego's Ethos Asset Management, Inc., has been handed an 87-month prison sentence for his role in an advance-fee loan scam that cost borrowers more than $17 million, as reported by the U.S. Department of Justice. U.S. District Judge Robert S. Huie condemned the actions as “reprehensible”, highlighting the deceptive nature of Santos' enterprise.
In January 2025, Santos, a 30-year-old Portuguese national, pled guilty to charges including wire fraud conspiracy and aggravated identity theft. Following his arrest in November 2023, Santos has remained in custody. His company, which portrayed itself as a provider of full-service project financing, seduced borrowers with fabricated tales of Ethos' financial stability, the extent of its capital, and a nonexistent history in funding projects. However, these draws manifest as nothing more than mirages, leaving these businesses gasping for air in a desert where they thought they saw water.
According to the plea agreement, Santos confessed to utilizing incoming upfront fees as a Ponzi-esque scheme, supposedly to release collateral of prior borrowers and fund loans for others. In one instance, Santos induced a borrower to wire money by presenting a falsified bank statement showing Ethos holding $100,304,447.46 in funds, far from reality. Moreover, financial statements were altered, and signatures were forged to feign an audit by a legitimate accounting firm, all to deceitfully obtain more upfront fees and bolster Ethos' facade of prosperity.
"Fraud like this is a calculated abuse of trust," U.S. Attorney Adam Gordon was quoted in the DOJ report, emphasizing the real, measurable, and lasting impact of such scams. Special Agent in Charge for HSI San Diego, Shawn Gibson, also flagged the paramount role of legitimate businesses in the economy and committed to shielding them from the claws of "greedy scammers." The plea deal sketches out Santos' transgressions, signaling a future restitution hearing that could shed light on the full extent of his financial obfuscations and their implications on additional victims, as per the U.S. Attorney's Office.
