Having been the first Black mayor of Jacksonville from 2011 to 2015, before his role at the NTSB he held a senior position as adviser for community infrastructure opportunities at the U.S. Department of Transportation. Brown also had a rich background in public service dating back to the Clinton administration. While working under President Bill Clinton and Vice President Al Gore, he was responsible for advising on various domestic issues and took on roles such as the executive director of the White House Community Empowerment Board, according to a statement obtained by First Coast News.
In the lawsuit, the significance of the NTSB's independence was underscored, a principle established to ensure that transportation disasters are investigated with expertise and without political sway. Victoria Nugent, the legal director at Democracy Forward, emphasized this point, stating, "Congress made the National Transportation Safety Board independent for a reason: to ensure that investigations into transportation disasters are driven by expertise and evidence." "The termination of Mr. Brown and the undermining of the independence of this Board does nothing to keep people safer," she added.
