
Hawaiʻi Island police have taken 29-year-old Kailua-Kona resident Emmy Cedeno Perez into custody, in response to a series of peculiar events about an unauthorized parking enforcement tactic, namely the use of a so-called "barnacle" device; this announcement cames after a detailed investigation into two separate incidents involving parked vehicles near the Ka‘awaloa Trailhead in Captain Cook, a public space curiously free from any official parking restriction signage. Nixle reported on Friday that the "barnacle," which is essentially a suctioned immobilization device enforcing payment for removal, was unlawfully placed on vehicles in an area not designated for such enforcement, prompting a police investigation that ultimately led to Perez's arrest.
Intricacies of the "barnacle" system involve a forced payment via instructions on the device for its removal, following which, the vehicle owner obtains a code to release the device and is instructed to return it to a drop box for some form of restitution, even though the area lacked any official 'no parking' proclamations that would typically warrant such parking enforcement actions; the suspect, Mr. Perez, was charged with numerous offenses, including fraud, theft, and criminal tampering, according to police records.
The culmination of this case found Perez, held on charges inclusive of fraud, third-degree theft, second-degree criminal tampering, failure to appear, contempt of court, and driving without a valid license, making an $11,600 bail payment and earning a conditional freedom ahead of his June 26 court appointment, reported by Nixle.
