In a recent public notice, the Yavapai County Sheriff's Office announced an upcoming civil sale set for July 9, 2025, in Prescott, wherein a residential property will be auctioned off to the highest bidder. The sale is the result of a legal judgment against Charles C. Brooks, trustee of the Brooks Family Trust, Trust A, and the Audrey Gorham Trust, 1992, among others, according to the notice posted by the YCSO. The Sheriff's Office states that the sale is an execution issued by the Superior Court of the State of Arizona in Yavapai County, case number P1300CV202200853.
The property in question, located at 1923 E. Mountain Hollow Drive, Prescott, AZ 86301, will be sold to satisfy a judgment entered on February 20, 2024, in the amount of $4,908.15. The notice describes the property as "LOT 14, PRESCOTT CANYON ESTATES UNIT II," along with improvements and rights pertinent to the property, albeit subject to current taxes, assessments, easements, and other legal considerations. The public notice also makes clear there is a 30-day redemption period following the sale, in addition to a five-day grace period.
The official notice, signed by David Rhodes, Sheriff of Yavapai County, further advises debtors that Arizona Revised Statutes may offer protections for their residences through the homestead exemption. "If you are in doubt as to your rights, you should obtain legal advice," the notice emphasizes. Sheriff Rhodes underscores the importance of understanding one's legal options and protections in such circumstances.
The sale will occur on the north steps of the Yavapai County Courthouse, at 10:00 AM sharp. Individuals interested in the sale or in the protections available to homeowners, deputies at the Yavapai County Sheriff's Office, including Lt. Jarrod Winfrey, should be able to provide more information and answer questions. For those with stakes in the outcome of this auction or others like it, the unfolding of this legal process will no doubt be of keen interest.
