After multiple delays, a new trial date is set for Ezekiel Kelly, the man accused of a mass shooting spree across Memphis that occurred on September 7, 2022. Kelly, who allegedly killed three individuals and wounded several others during the hours-long ordeal, is now scheduled to stand trial on February 9, 2026. This information comes from recent court proceedings covered by WREG and Local Memphis.
During the shootings, Kelly is accused of beginning his spree by killing Dewayne Tunstall, continuing to wreak havoc across the city, and live-streaming part of the attacks, causing public panic and leading to a widespread city lockdown. He faces nearly 30 charges, including first-degree murder, reckless endangerment, and terrorism — the latter being a particularly unusual charge in Tennessee. According to a WREG report, Michael Scholl, Kelly's defense attorney, explained the complexity of the case by stating, "It's a case that involves seven crime scenes, three homicides. It involves at least approximately 80 witnesses on behalf of the government."
Despite entering a not guilty plea, Kelly remains incarcerated without bond, as the Shelby County District Attorney's Office has asserted its intention to seek the death penalty if he is convicted of the first-degree murder charges. As reported by Local Memphis, Kelly's next court appearance is set for September 16, 2025, which will be his last opportunity to change his plea before the trial proceeds.
Kelly's defense team has also indicated plans to file a motion to change the venue in hopes of selecting a jury from outside Shelby County — a decision they hope will ensure impartiality given the high-profile nature of the case. "We still have a lot of witnesses to talk to and a lot of preparation before we get to February," Scholl told FOX13 Memphis in recognition of the arduous undertaking before them.
