In a revealing case of betrayal of trust, 67-year-old Todd Bernstein of Birmingham has entered a no-contest plea on multiple charges of insurance fraud. The Michigan Attorney General's Office released a statement detailing Bernstein's actions, which exploited primarily senior clients in an annuity scheme. Operating as a Michigan insurance agent, Bernstein falsified applications to conceal the truth about new annuities he was pushing on clients; they were, unbeknownst to them, funded by prematurely surrendered ones, generally to the financial detriment of the clients.
The repercussions for Bernstein's act of fraud are severe. Michigan Attorney General Dana Nessel underscored the severity of these crimes by ensuring Bernstein's repayment of $107,918.13 in restitution and the surrender of his insurance license. In the heart of their announcement, Nessel deplored, per the Michigan Attorney General's Office, "Insurance fraud, especially schemes targeted at our seniors, cannot and will not be tolerated." Bernstein's cooperation with the plea agreement does not stem the tide of justice's demand, as a sentencing date looms on October 16, 2025, at the 6th Circuit Court in Oakland County.
The efforts of the Michigan Department of Insurance and Financial Services (DIFS) were instrumental in bringing Bernstein to account. DIFS Director Anita Fox emphasized the cascading impact of insurance fraud on all Michiganders, noting in the statement that it increases costs for all Michiganders. To this end, Fox affirmed DIFS' ongoing commitment to collaborate with the AG's office to root out fraud and protect the consumers in their state. Tips and suspicions regarding fraudulent activities can be reported to the DIFS, an opportunity for community vigilance to aid in oversight.
