In a notable turn of events within Massachusetts' cannabis sector, Shannon O'Brien has been ordered reinstated as chair of the Cannabis Control Commission (CCC). Judge Robert Gordon of the Superior Court deemed Treasurer Deborah Goldberg's decision to terminate O'Brien unlawful, as reported by MassLive. O'Brien faced suspension in September 2023 and subsequent dismissal a year later, following two external investigations and nearly 19 hours of private summer meetings. However, her legal challenge proved fruitful as the judge ruled in her favor today.

O'Brien contested the allegations of "gross misconduct" brought forth by Goldberg and found success in her court appeal. "The question before the Court is not whether [O'Brien] was abrasive, boorish, inconsiderate, ill-tempered, imprudent and/or otherwise unreasonable -- either in actuality or in the reasonable estimation of the Treasurer," Judge Gordon clarified, as Boston 25 News reported. These traits, he continued, do not constitute sufficient cause for removal under statute's stringent terms.

Instead, the pivotal question was whether the treasurer's decision to remove O'Brien met the statutory definitions of "gross misconduct" and inability to "discharge the powers and duties" of the chair. Gordon firmly stated that the decision did not withstand a proper examination of the facts and correct application of the law. "On any fair reading of the facts, and any proper application of the law, the decision fails on both counts," he declared to Boston 25 News.

With this ruling, Gordon granted O'Brien immediate restoration of her position, complete with back pay and benefits dating from her termination. O'Brien's original term was set to continue until August 31, 2027, ensuring her a lengthy duration yet at the helm of the CCC. As the CCC’s spokesperson relayed to MassLive, O'Brien does indeed plan to resume her responsibilities with the commission.
