Abbi Silver, a retired Nevada Supreme Court justice, recently filed a lawsuit against Real Water and several associated retailers, alleging that the company's bottled water is to blame for her husband's fatal case of ALS. Silver's husband, Kirk Jaster, was diagnosed with the neurodegenerative disease in February 2022 and passed away in September 2024, according to a lawsuit detailed by News 3. The complaint asserts that hydrazine, a toxic chemical found in the water, was a contributing factor to Jaster's illness.

Silver, having resigned from the high court to provide care for her husband before his death, has since been appointed to the Nevada Gaming Commission. The couple, once attracted by a recommendation from UFC fighter Gray Maynard to drink Real Water, believed the product to be beneficial for health. As reported by the Las Vegas Review-Journal, Maynard, who has himself suffered liver failure and filed a lawsuit against Real Water, was not named as a defendant in Silver's lawsuit.

A representative from Real Water, who has faced a barrage of legal challenges and multibillion-dollar verdicts over the toxicity of their product, was not available for comment on the fresh allegations. Previous lawsuits have linked the water to non-viral hepatitis and liver damage, resulting in formidable damages awarded to the victims, including a combined judgment of over $11 billion in past cases, as collected from both News 3 and the Las Vegas Review-Journal.

In addition to Real Water, the lawsuit names retailers such as Sprouts Farmers Markets and food distributor KeHE, failing to issue responses when approached for comment, as defendants. Wrongful death, negligence, and failing to warn are among the allegations cited by Silver's attorneys in the suit, which reportedly is the fifth case to tie Real Water to a fatality. Both reports indicate that Silver’s lawsuit alleges that as many as 90 other people have suffered injuries from consuming Real Water. Some of these injuries include miscarriages and the need for aborted liver transplants, with at least one emergency brain surgery being required.
