A former police officer in Ellwood City, Pennsylvania, is facing multiple charges after an altercation inside a Sheetz convenience store became a legal issue. According to WPXI, Robert Magnifico, who has since retired from the police force, has been charged with simple assault, official oppression, tampering with public records, and unsworn falsification to authorities following an incident captured on camera where he reportedly shoved a 19-year-old man to the ground.
The confrontation began on June 6th, when the young man realized he had left his phone at the Sheetz on Fifth Street, and despite offering the correct passcode, the store staff did not return the phone and police were summoned, According to details shared by WPXI, what followed was a clash that escalated when Magnifico allegedly came from behind the store counter to confront the 19-year-old and his friend, resulting in the physical confrontation.
Additional information provided by CBS News Pittsburgh indicates that during the incident, the victim's friend recorded the altercation; this footage reportedly shows Magnifico grabbing the recording device and throwing it, and it later went viral, initiating an official inquiry into his conduct.
Pennsylvania Attorney General Dave Sunday was noted saying, "The encounter, which was captured on video, shows a sworn officer engaged in abusive and intimidating behavior that is clearly out of bounds, and, in fact, a series of criminal acts", underscoring the severity of the allegations against the former sergeant. These actions, according to Sunday, not only overstepped the realm of proper conduct but also compromised the public trust that is essential to the relationship between law enforcement and the community they serve; Sunday's statements were obtained through a report by CBS News Pittsburgh.
A preliminary hearing for the case against Magnifico has been set for November 18.
