
In a recent turn of events, former San Rafael Police Officer Brandon Nail has been acquitted of all charges related to an incident involving the use of force. The jury's decision, as reported by the City of San Rafael's official website, follows an internal investigation and a series of legal challenges that culminated in an arbitrator overturning Nail's dismissal.
On July 27, 2022, Nail was involved in an incident with a man named Julio Lopez, which eventually led to scrutiny over the officer's conduct and his subsequent placement on administrative leave. The independent investigation concluded that Nail violated department policy, leading to his termination from the force. In a contested arbitration, however, the arbitrator ruled in favor of Nail, mandating his reinstatement with full back pay as the City had, no recourse due to the terms set by the San Rafael Police Association’s collective bargaining agreement.
Despite the internal findings, Nail maintained his right to work as a peace officer as the California Commission on Peace Officer Standards and Training (POST) has signaled plans to restore his certificate post-acquittal. The independent entity had suspended the certificate pending the trial's outcome, aligning with the notion that Nail should not serve as an officer if found guilty of criminal misconduct.
In response to evolving community concerns and to bolster public trust, the City of San Rafael established the Police Advisory and Accountability Committee (PAAC) in 2024. PAAC, composed of community stakeholders, is tasked with increasing the department's transparency and accountability. Furthermore, the city has invested in the Specialized Assistance for Everyone (SAFE) mobile response team, which fields calls traditionally directed at police and fire departments.
