A quiet afternoon in West Berkeley turned chaotic when a woman allegedly attacked a father who was shielding his 3-year-old on the swings, leaving the family shaken and a suspect in custody. Officers arrested a 49-year-old woman at the scene, and court records show Alameda County has filed charges.
The confrontation unfolded around 1:30 p.m. Tuesday at Dreamland Playground on Bolivar Drive, on the northeast side of Aquatic Park, when a woman approached the father and son “yelling and screaming” and tried to wedge herself between them, according to The Berkeley Scanner. Witnesses and police said the father used his body to protect the child while his wife led their other child away to safety, and the woman kept striking him until he broke free.
Arrest and charges
Berkeley police arrested the suspect, identified as Kelly Moy, without incident and booked her into Santa Rita Jail. The woman “kicked, punched and scratched the father while his wife came … to take their 3‑year‑old and other child away to safety,” The Berkeley Scanner reported. Court records show the Alameda County district attorney filed a misdemeanor battery charge and set bail at $10,000. Moy is slated for arraignment Thursday at the Wiley W. Manuel Courthouse in Oakland.
Where it happened
Dreamland Playground anchors the east side of Aquatic Park and is a go-to spot for families in West Berkeley, in the 100 block of Bolivar Drive. The city has been pursuing upgrades and stormwater work in the area to keep the park humming as a neighborhood hub, according to the City of Berkeley.
Legal context
The Alameda County filing in this case is a misdemeanor battery charge. Under California law, simple battery is typically a misdemeanor, carrying up to six months in county jail and fines, per legal overviews. By contrast, kidnapping-related offenses and certain child endangerment or abduction allegations can bring far stiffer state prison terms depending on the evidence — which is why prosecutors tailor counts to the facts, as summarized by legal resources.
Thursday’s arraignment will be the first public court appearance in Alameda County Superior Court. Court records cited in local reporting indicate Moy had no other active criminal cases there at the time of filing. We will update coverage if additional filings or official statements are released.
