The indictment states that on August 14, Lary registered to vote and later filed to run for Stonecrest City Council District 5, allegedly signing documents falsely declaring he was not a convicted felon. His candidacy ended when the DeKalb County Board of Registration and Elections voted unanimously on September 10 to remove him from the voter rolls and disqualify his bid for office.

This action led to the district attorney’s investigation and the resulting charges. Lary’s attorney has informed authorities that he intends to surrender voluntarily. His arraignment date has not yet been set.

Lary previously served a four-year, nine-month federal prison sentence for wire fraud and theft of federal program funds, followed by probation beginning in February.
