
A Memphis gynecologist, Sanjeev Kumar, aged 44, is facing a new round of legal trouble with a second superseding indictment returned against him by a federal grand jury. This comes following allegations that Kumar conducted unnecessary procedures and misused medical devices, according to the U.S. Attorney's Office for the Western District of Tennessee.
The accusations are serious: Kumar is alleged to have employed medical devices in an unsanitary manner by reusing them on patients without proper sterilization, as required by health regulations. He is also accused of fraudulently billing Medicare and Medicaid for these services as if they were indispensable and as if new or adequately reprocessed devices were used each time. These illicit practices reportedly stretched from September 2019 through April 2024. Previously in February and June 2025, Kumar faced initial accusations. However, defenses put forth by Kumar managed to have several counts dismissed by Chief U.S. District Judge Sheryl H. Lipman, who indicated that charges for adulteration and misbranding must target individual acts and not broadly apply to continuous conduct. In response, federal prosecutors have returned to the grand jury and secured additional charges, each describing single incidents of the alleged wrongdoing. The latest indictment includes 27 new counts of adulteration and misbranding, aligning with Judge Lipman's October 17 directive.
The intensifying case against Kumar is slated to be presented in court on December 1, as stated by the U.S. Attorney's Office for the Western District of Tennessee. The investigation backing up this case was carried through by multiple federal agencies including the HHS-OIG, FDA-OCI, FBI, and TBI. Assistant United States Attorneys Lynn Crum, Scott Smith, and Sarah Pazar Williams are leading the prosecution efforts.
