
The Ozaukee County District Attorney's Office decided against filing charges in a fatal collision that occurred last month, where a pickup truck driven by a 74-year-old struck and killed Mailee Xiong Hang in a Saukville Walmart parking lot. WISN reports that after a "thorough review of the evidence shows the crash causing Ms. Hang's death was a tragic accident,” the conclusion was that Ms. Hang's death was, indeed, a tragic accident.
The incident unfolded on October 26, when Hang was hit while loading groceries into her car, according to TMJ4. Her death prompted her sister, Mai Xiong, to use social media to call for justice, urging prosecutors to file charges. The family was met by officials from both the District Attorney's office and the Saukville Police Department on Tuesday, who informed them that the driver would not be charged.
District Attorney Ben Lindsay, citing a blend of evidence that included surveillance footage, investigative reports, and vehicle inspections detailed by GMToday, stated, "This was a very sudden and tragic incident which resulted in the death of a pedestrian, Mailee Hang." Lindsay further explained that while the driver's operation of the vehicle unquestionably resulted in Hang's death, there was no evidence suggesting criminal negligence.
Surveillance video shows the moment the vehicle accelerated unexpectedly, involving a concrete handicap signpost and two other vehicles, after the driver purportedly confused the accelerator with the brake, Lindsay noted. Subsequent vehicle inspection and crash reconstruction supported the driver's claim, which played a decisive role in the decision not to pursue charges. Despite the driver's admission of mistake, the evidence collectively led to the ruling that there was no criminal intent at play.
