In a battle that highlights the complexities of parental rights law in Georgia, a father has emerged with full custody of his infant son following an emotionally charged legal struggle. Adrian Harden's struggle began in the wake of his girlfriend Adriana Smith's tragic medical condition, which saw her declared brain-dead during pregnancy due to complications from blood clots and subsequently kept on life support until their child could be born.
Harden's ordeal was rooted in a grim reality where, despite a DNA test confirming his paternity, he found his rights to his son, Chance, obstructed by state law. As reported by FOX 5 Atlanta, Harden had to fight for the recognition of his legal status as a father, a fight compounded by his unmarried status to Smith. This lack of automatic parental rights placed him in a precarious position, risking the placement of his child into foster care unless he could obtain a judicial grant of custody.
It was only after an emergency petition by Better Law Divorce Lawyers for legitimation and custody and a court order in September granting Harden temporary rights that a semblance of stability seemed to return for him and Chance. A final custody order issued by Judge Latisha Dear-Jackson on Dec. 2, 2025, allowed Harden to bring his son home permanently, as per a report by Atlanta News First.
"I cherish every moment with my son, and I'm so proud of my girl. My baby girl. I know she, I love to see him," Harden told FOX 5 Atlanta. The legal firm representing him pointed out how Georgia's laws are particularly harsh on unmarried fathers, hinting at systemic barriers that could disproportionately affect minority and low-income fathers.
Melaniece Davis, an attorney who advocated for Harden, stated, "Mr. Hardin did not have any legal rights here in Georgia. If a father has a child with a woman he is not married to, that father has no legal rights whatsoever," according to FOX 5 Atlanta. Smith's family cited Georgia's stringent abortion laws as the reason she was kept alive until the baby could be born, a poignant footnote to an already heart-wrenching story.
Following these events, Harden has chosen to speak out, with hopes his experience will bring about legal reform. While the ordeal has undoubtedly taken an immense toll, Harden's commitment to his son remains unwavering as he seeks to impart his mother's spirit upon Chance. "I just look at him, I see his mama. He's got a lot of life, a lot and a lot of spirit. So, I just keep that going," he shared with FOX 5 Atlanta.
