A routine traffic stop on Florin Road turned into something far more serious when Sacramento police say they pulled a machine gun with a silencer, ammunition and cocaine out of an RV parked on city streets.
On Dec. 1, officers with the Sacramento Police Department’s South Problem Oriented Policing unit stopped the RV in the 3800 block of Florin Road and, according to the department, found the illegal weapon and drugs inside. The RV’s owner, identified as 63-year-old Gary Elliott of Sacramento, was arrested on weapons and drug-related charges, and officers say he was on probation at the time. The discovery has raised uncomfortable questions about how prohibited weapons and narcotics were being stored in a vehicle sitting in public view.
According to a Facebook reel posted by the Sacramento Police Department, SPOP officers initially stopped the RV after noticing expired registration, then searched the interior. In the video, officers are seen photographing and cataloging evidence at the scene as they lay out what they say they found inside.
What officers recovered
The department says officers pulled a machine gun equipped with a silencer from the RV, along with ammunition and what was described as a small amount of cocaine. Police impounded the vehicle and photographed the items as evidence before arresting the owner on weapons and drug-related counts. The suspect was identified in the department’s account as 63-year-old Sacramento resident Gary Elliott.
Legal stakes for a machine gun and silencer
Federal law treats this kind of hardware very seriously. Under 18 U.S.C. § 922, possession of machine guns is generally prohibited, and the National Firearms Act governs silencers and other tightly regulated items. Violations of those statutes, particularly when weapons are tied to drug offenses, can bring substantial federal penalties that may include prison time and fines. Whether this case turns into a state prosecution, a federal one, or both will depend on the evidence, the registration status of the weapon and any coordination between local and federal authorities, according to Cornell Law School.
What's next
The Sacramento Police Department’s reel states that investigators seized the weapon, suppressor, ammunition and cocaine for processing, then booked the RV’s owner on weapons and drug-related charges. The Sacramento County District Attorney’s Office will now review the investigation to decide whether to file state charges, and federal authorities could become involved if prosecutors believe National Firearms Act violations are in play. The department posted the video on Dec. 16, about two weeks after the stop, and as of publication it appears to be the primary public description of what happened on Florin Road that day, according to the Sacramento Police Department.
