
In a development that may shake the philanthropic community of Charlotte, local businessman and philanthropist Michael Kahn has been indicted on charges of tax fraud, stemming from activities related to the charitable foundation he established. According to the U.S. Attorney's Office, Kahn, who is the founder of The Michael A. Kahn Family Foundation, a tax-exempt organization, is accused of transferring more than $4.5 million to himself without reporting the funds as income on his tax returns filed for 2020 and 2021.
The case, which was brought to light by U.S. Attorney Russ Ferguson for the Western District of North Carolina, highlights the defendant's control over the foundation where he served as Director, President, Treasurer, Secretary, and Chairman of the Board of Directors since its inception in 2010, the IRS-CI led the investigation culminating in his indictment, and Kahn now faces multiple counts of aiding and assisting in the preparation of a false tax return, and failure to file a tax return for subsequent years. Kahn appeared in court before U.S. Magistrate Judge Omar J. Alboulhosn and was later released on bond; he could face up to three years in prison for each count pertaining to the false tax returns, and a year for each of the counts of failing to file.
After the court proceedings, the repercussions of such charges against Kahn, who has been a visible figure in local philanthropy, remain to be seen. Nonetheless, it's imperative to note, as emphasized by the U.S. Attorney's Office, "the charges against the defendant are merely allegations, and the defendant is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law."
