He was arrested after a short foot chase and has been suspended from his work at Maui Memorial Medical Center, where he was an independent contractor, as reported by Hoodline. Tommy Otake, attorney for Gerhardt Konig, filed two motions challenging the case, arguing that "The State did not present exculpatory evidence to the grand jury," and noting that "The law does require the government to produce any exculpatory evidence to the grand jury because it’s a matter of fairness." He claimed the indictment was defective, citing evidence that could show Konig's wife was not severely injured and criticizing the use of "triple-hearsay" involving Konig's son, according to Hawaii News Now.
Otake’s second motion focuses on insufficient notice regarding evidence against Konig, stating, "The indictment provides inadequate notice ... as to the particulars of the substantial step predicating the charged offenses of attempted murder in the second degree." He argued the defense deserves a clearer indictment or a bill of particulars specifying which 'substantial step' prosecutors relied on, with a hearing on these motions set for February 9, as per Hawaii News Now.
