El Paso resident Manuel Padilla will remain out of prison for now after pleading guilty to sexually assaulting two teenagers, but the deal comes with a long shadow hanging over his head. Authorities say he will serve probation for the convictions and could be sent to prison if he violates any terms of his supervision. The victims were 12 and 15 years old, and the abuse was reported to have occurred between August 2022 and June 2023.
Padilla entered his guilty plea on Jan. 29 and was sentenced to probation, according to the El Paso County District Attorney's Office, which spoke with KFOX14/CBS4. Prosecutors told the outlet that the plea agreement allows a judge to impose a sentence of up to 20 years in prison if Padilla fails to follow the rules of his probation.
Police records from the original investigation state that the two teens were assaulted multiple times, including once at a relative’s home and on at least two occasions in Padilla’s truck while it was parked on Fort Bliss property. In earlier reporting, investigators noted that "Padilla claimed the inappropriate touching was accidental." His arrest was first reported in November 2023 by KFOX14/CBS4.
What this means under Texas law
Because Padilla now has a qualifying conviction, Texas law requires him to register as a sex offender. That registry is maintained by local law enforcement and the Texas Department of Public Safety, and the rules are laid out in Chapter 62 of the Texas Code of Criminal Procedure. Both Texas Code, Chapter 62 and the Texas Department of Public Safety detail how often registrants must report, what information they must provide, and the penalties for failing to comply.
According to the El Paso County District Attorney's Office, the probation terms and sentence details were provided to local media, while the formal order and specific supervision conditions will be reflected in court records. Prosecutors say that by placing Padilla on probation, the court now has a standing mechanism to seek prison time if he breaks any of the conditions attached to his supervision.
