
Former state auditor Tobias Otieno, 41, of Hyde Park, is now on the wrong side of the ledger. He pleaded guilty yesterday in Wallkill Town Court after admitting he siphoned $405,843.25 from the Town of Wallkill while he was supposed to be conducting a New York state audit. Under a plea deal, prosecutors said they will recommend a prison term of four to 12 years when he returns to court for sentencing on June 1. Town officials say they reported the loss to the municipality's bank and the account was reimbursed.
How prosecutors say it happened
In court, Otieno acknowledged that he used the special access he had as an auditor to move town funds into business accounts he controlled. He put the time frame of the scheme between June 23, 2022, and Sept. 1, 2024. The case took shape after investigators followed a trail of suspicious transfers and then executed a search warrant at his Hyde Park home last July, according to the Times Union.
Investigation and the town's response
Investigators from the Orange County District Attorney’s Office and the Orange County Sheriff’s Office, working through the county’s White Collar Crimes Task Force, tracked the shifting money with help from forensic auditors in the state comptroller’s office. Prosecutors say town officials moved quickly to report the fraud, and the bank ultimately reimbursed the town for the missing funds. The probe did not turn up any evidence of wrongdoing by Town of Wallkill employees, as per News 12.
Alleged laundering through consulting accounts
Prosecutors say that roughly $405,843.25 in town money ended up in accounts tied to Otieno’s consulting outfits, including Toncye Consulting and Tozaq Accounting Services, while he was reviewing payroll, procurement and other disbursements. Local reporting and the district attorney’s office have detailed both the transfers and the terms of the plea deal, as reported by Daily Voice.
Charges and potential sentence
Otieno pleaded guilty to second-degree grand larceny as a public corruption crime, a class B felony under New York law. The plea entered in Wallkill Town Court notes that county prosecutors will recommend a sentence of four to 12 years in state prison. Officials weigh in
State Comptroller Thomas DiNapoli blasted the conduct as a "betrayal of trust" and said his office carried out detailed forensic analyses after the allegations surfaced.
