A Sunday evening ride in Mulberry ended in a hospital trip for a motorcyclist and a jail stay for a driver investigators say had been drinking, after a dark sedan clipped the bike and took off. Deputies later tracked down a damaged car nearby, arrested the driver, and say he is now sitting in the Polk County Jail on an ICE detainer while the injured rider recovers from a concussion and a broken arm.
Crash And Arrest
According to Tampa Free Press, the crash unfolded around 7:40 p.m. at Church Avenue North and Carter Road West. Witnesses told deputies a sedan cut through a Walmart parking lot, ran a stop sign and pulled straight into the motorcyclist's path before hitting him and speeding away.
Deputies reported finding a black Scion idling nearby with smoke billowing from its crushed front end and several open beer cans inside. The driver and two passengers all appeared to be intoxicated, investigators said. Reporters identified the driver as 24-year-old Gudiel Miguel-Vasquez, who, according to the outlet, admitted through a translator that he had been behind the wheel and left the scene after the impact.
Charges And Immigration Hold
As outlined by the Polk County Sheriff's Office, local prosecutors in recent cases have pursued upgraded charges when suspects are in the country illegally, and deputies coordinate with federal immigration authorities to request detainers. Investigators say that is why an ICE detainer was placed on Miguel-Vasquez after his arrest.
Victim And Next Steps
Tampa Free Press reports the motorcyclist was transported to a local hospital with a concussion and a broken arm. The outlet adds that Miguel-Vasquez faces enhanced counts, including leaving the scene of a crash involving injury and DUI with property damage.
The two passengers were cited for open-container violations and taken into custody on civil detainers, according to the same report. Records cited by the outlet indicate all three men are from Guatemala and that the driver did not have a valid driver's license. Deputies said they plan to forward the case to the State Attorney's Office for formal charging decisions.
Legal Implications
Under Polk County practice cited by law enforcement, immigration status can "upgrade" criminal charges by one level, which can turn misdemeanors into felonies and increase potential penalties. As outlined by the Polk County Sheriff's Office, that charging policy, combined with an ICE detainer, can influence custody and bond decisions as the case moves to prosecutors and through the courts.
