What the law says
Under Texas law, a driver involved in a crash that results in injury or death is required to stop, provide help when possible, and exchange identifying information. Per Texas Transportation Code §550.021, failing to stop after a collision that causes a death can be prosecuted as a second-degree felony. If investigators ultimately find evidence of impairment, prosecutors could also seek intoxication manslaughter charges under Texas Penal Code §49.08.
