
AUSTIN — A quiet early Monday in southeast Austin turned into a crime scene when police say a 22-year-old man forced his way into a home and assaulted an adult woman before officers arrived and arrested him a short time later. He was booked on felony counts, and the case is still unfolding.
According to the Austin Police Department, officers were sent to a southeast Austin residence around 2:26 a.m. after a report of a burglary and criminal sexual conduct, per KAAL. That outlet reports officers found the man at the scene and that he initially denied going into the residence.
Local coverage identified the suspect as 22-year-old Joshua Swank and reports he was booked into the Mower County Jail on suspicion of first-degree burglary and fifth-degree criminal sexual conduct, according to KTTC. Police allege Swank entered the home and assaulted an adult woman, but so far authorities are keeping most details under wraps.

Under Minnesota Statute §609.582, first-degree burglary covers entering an occupied dwelling without permission with intent to commit a crime, or actually committing a crime while inside. It is a felony under state law.
Minnesota Statute §609.3451 defines fifth-degree criminal sexual conduct, which generally involves nonconsensual sexual contact and can carry misdemeanor or felony penalties depending on the circumstances.
