
In a recent Department of Justice report, we learn of a significant breach of trust within the American labor movement, as the former president of the Local 2805 chapter of the American Federation of Government Employees (AFGE), Felix Luciano, was sentenced for embezzling union funds. Luciano, a former Department of Homeland Security officer, has been sentenced to four months in custody, ordered to repay $36,000, and fined an additional $10,000 for misappropriation of union funds, as per the U.S. Attorney's Office, Southern District of California report.
Between 2016 and 2018, Luciano used Local 2805's funds for various personal expenses, such as shopping, travel reimbursements, groceries, and dining. He committed these acts by writing checks from the union's account and using debit and credit cards directly linked to the union's funds. Consequently, his actions resulted in a total loss of $36,000 for Local 2805, which represents Department of Homeland Security employees in San Diego and Imperial Counties.
In an attempt to hide his embezzlement, Luciano underreported the amount of money he received from Local 2805 and the organization's cash balance in a Form LM-3 report filed in 2018. The Form LM-3, a financial report required to be submitted annually to the United States Department of Labor, Office of Labor-Management Standards, is a document detailing an organization's financial information over the previous year. Luciano's concealment of his embezzlement affected not only the Department of Labor but also his fellow union officers and the membership that provided the embezzled funds through their dues.
When discussing the case, Acting U.S. Attorney Andrew R. Haden emphasized the importance of trust within labor organizations: "When workers devote their hard-earned money to labor unions, they rightly expect the officers to be honest stewards of their dues." Haden hopes that Luciano's criminal prosecution will serve as a deterrent for others contemplating similar actions.
As highlighted by this case, the need for increased transparency and financial vigilance within labor unions becomes more apparent. A commitment to honesty and efficient use of members' dues for the betterment of the organization is essential in maintaining the trust necessary for labor organizations to function adequately. Ed Oquendo, District Director of the U.S. Department of Labor, Office of Labor-Management Standards, concurred, stating that while the majority of union officials carry out their duties diligently, instances of criminal violations must be addressed with utmost urgency.
According to Carroll Harris, Postal Inspector in Charge of the Los Angeles Division, this success can be attributed to the hard work and collaboration of various law enforcement agencies.
