A Cape Cod woman has filed a lawsuit against a New Hampshire ski resort over injuries sustained in a February tubing crash, as reported by both Boston.

Zoia Tsoleridis alleges that a Loon Mountain employee's negligence and disregard of the resort's rules led directly to her injuries. The employee supposedly provided Tsoleridis and other adults with child-sized 'tot tubes,' which don't feature brakes like adult ones, leading to the devastating accident, she claimed in her October 3rd federal lawsuit.

According to a report by Patch, Tsoleridis and her family were on vacation at the Lincoln ski resort during the weekend of February 11th. They wanted to buy adult tubing passes but found they were sold out and only children's passes were available. Upon reaching the tubing hill, an employee told them an absent group had booked the hill allowing Tsoleridis's group to tube. However, the adults were given 'tot tubes' without any warning that these tubes were brakeless.

Nearing the end of the tubing hill, Tsoleridis found herself unable to slow down. She subsequently suffered a traumatic brain injury, an aortic aneurysm, and broken arms and jaw in the resulting crash, as stated by Boston. Furthermore, she had to be airlifted to Dartmouth Hitchcock Medical Center, where she spent considerable time in the Intensive Care Unit (ICU).

Loon Mountain's internal regulations prohibit employees to from handing out 'tot tubes' to adults, as stated in the resort's tubing FAQ section. Accordingly, the resort is alleged to be guilty of negligence, negligent misrepresentation, and violation of safety guidelines for providing Tsoleridis with a 'tot tube' and then failing to notify her about its lack of brakes.

The lawsuit further alleges that the resort must have been aware of the 'tot tube''s potential for danger when used by adults. It thereby holds them strictly liable for Tsoleridis's extensive injuries. She is seeking a jury trial to confirm whether she is due damages in an amount exceeding $75,000, according to a CBS News report.
