
Massachusetts Attorney General Andrea Joy Campbell, in collaboration with 24 attorneys general, has filed an amicus brief in the U.S. Supreme Court. They are supporting calls by the U.S. Food and Drug Administration (FDA) and Danco Laboratories LLC to overturn the U.S. Court of Appeals for the Fifth Circuit's ruling. This ruling reinstated several regulations on medication abortion deemed medically unnecessary by the coalition. The affected drug, mifepristone, remains the singular FDA-approved abortion drug. Its restricted access is seen as a significant threat to reproductive health care, notably within low-income and underserved communities, as per a press release from the Attorney General's office.
AG Campbell asserted the essential nature of mifepristone in guaranteeing evidence-based reproductive healthcare and supporting bodily autonomy rights in her statement. The legal group appeals to the Supreme Court to approve the FDA's and the drug maker's petitions and consequently overturn the Fifth Circuit's verdict, which constrains mifepristone's prescription and distribution. The brief additionally criticizes the decision as neglecting years of reliable evidence and clinical research authenticating the safety and effectiveness of mifepristone.
If the ruling of the Fifth Circuit goes unchallenged, it could hinder access to the most typical form of abortion. This could lead to widespread adverse consequences for numerous individuals needing abortion care or treatment of pregnancy loss. Potential repercussions might include increased risks and costs of delayed abortion procedures, a shift towards procedural abortion, and limited access to reproductive healthcare services. Furthermore, the coalition contends, the decision would spark confusion amidst providers, distributors, and pharmacies. It could also severely destabilize the regulatory process for drug approvals and impede scientific innovation and nationwide availability of countless drugs.
Earlier this month, Campbell launched the Reproductive Justice Unit aimed primarily at extending and safeguarding access to reproductive and gender-affirming care, addressing disparities in maternal health, combatting misleading information blocking access to care, and countering national attacks on reproductive healthcare. This step further underscores Massachusetts' dedication to reproductive justice and its efforts in preserving the state's robust legal protections for reproductive rights.
In fighting for the reversal of the lower court's ruling on medication abortion, the coalition includes attorneys general from myriad states. These are Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Washington, and Wisconsin, along the District of Columbia.
