A Cook County judge has dismissed a lawsuit by Winnetka resident Robert Schriesheim against the Winnetka Park District and billionaire Justin Ishbia. The dispute is over a contentious proposed land swap according to a Chicago Tribune article. Schriesheim's lawyer has expressed plans to amend the lawsuit, which alleges misuse of public trust.
Schriesheim's lawsuit, filed in October 2022, posited that this proposed exchange violated regulations relating to public land and the public trust doctrine. Nevertheless, the Circuit Court of Cook County found that the Park District's appraisals were both reasonable and punctual, and claimed Schriesheim did not furnish enough evidence that the Park District acted unfairly as reported by The Record North Shore.
The exchange has experienced many setbacks since 2020, originating from Ishbia's ultimately withdrawn plan for a steel wall to separate his property and the park. Varied objections from the community and members of the Park District board have also added to delays. The outcome of the proposal remains unclear despite these developments as reported by Chicago Tribune.
Winnetka Park District officials, including Park District President Christina Codo, hailed the court's dismissal of the lawsuit. She said the park board has always operated with the community's best interests in mind and claimed that this will continue to guide their actions as they move forward with lakeshore enhancements according to The Record North Shore.
The court dismissed three counts in Schriesheim's lawsuit, with only two dismissed with prejudice. The third count, pertaining to the exchange of public trust land, was dismissed without prejudice. This grants Schriesheim the opportunity to file an amended complaint. Schriesheim's attorney, Paul Gaynor, has confirmed his client's intention to prove the proposal as "arbitrary and unreasonable" and in violation of the public trust doctrine, as stated in The Record North Shore article.
Ishbia has proposed a $3 million donation to the Winnetka Park District, targeted towards improvements to Elder and Centennial beaches. However, the Park District board must first accept this donation, rendering the situation even more multifarious according to Chicago Tribune.
