Yesterday, a radiology tech from Boston Medical Center (BMC) was arraigned on drug fraud charges. Rafael Garcia, 44, is charged with conspiracy to violate drug laws, obtaining drugs by fraud, and larceny of a drug, WHDH reports, also confirmed by the Boston Herald.

District Attorney Kevin Hayden stated, "Insurance fraud hurts everybody," adding the case demonstrates "an added level of medical and professional duplicity." He commended the vigilant pharmacist who alerted authorities about suspect prescription patterns involving Garcia's co-worker, nurse practitioner John Cann, as per the Boston Herald.

The Massachusetts State Police Narcotics Unit's investigation into Cann revealed the extensive prescription scheme involving Garcia. Cann was arraigned earlier this year on associated charges. He allegedly wrote numerous prescriptions for Garcia between February 2021 and June 2023, despite Garcia not being his patient, WHDH reported. Garcia billed the medications, which Cann retrieved himself, to his health insurance.

The medications, Clonazepam, Adderall, Lorazepam, Dextroamphetamine, and Amphetamine are typically prescribed for seizures, anxiety, ADHD, narcolepsy, and other conditions. Injectable testosterone and Androderm patches are used primarily in testosterone replacement therapy for adult males. Each of these has a significant risk of abuse and addiction.

Alongside misuse, the case highlights the broader impact of insurance fraud. By using their professional privileges to illicitly acquire the medications, Garcia and Cann piled on additional costs to the healthcare system and insurance companies, affecting all stakeholders.

The collaborative efforts by all stakeholders in investigating this case, from the pharmacists who identified irregular prescription behavior to the Massachusetts State Police Narcotics Unit and the state Insurance Fraud Bureau, underlines the importance of cooperation and vigilance in addressing such misconduct.

Garcia is held on $2,500 bail and is set to return to court on December 29 for a pre-trial hearing, as reported by the Boston Herald.
