Garza, meanwhile, has been embroiled in legal controversy, facing allegations of being a "rogue DA." A lawsuit filed by Travis County resident Jason Salazar and penned by former Republican DA candidate Martin Harry seeks to outright remove him from office. This legal move leverages House Bill 17, which makes it possible to directly challenge district attorneys who enact policies that are perceived to negligently not comply with state law. The focus here lies on Garza's policies concerning the prosecution – or lack thereof—of marijuana-related offenses and abortion. Garza has dismissed the lawsuit as "meritless" and alleged that it is a political maneuver to subvert the will of local voters, as reported by KVUE.
The legal scuffle adds more tension to Garza's re-election campaign, tilled with accusations that call into question his adherence to law enforcement standards.
