
A former Hialeah police officer, Rafael Otano, has been hit with a 66-month prison sentence following a conviction for the armed kidnapping of a homeless man, Jose Ortega-Gutierrez, as confirmed by Local10. The incident, which occurred back in December 2022, saw Otano alongside another officer, Lorenzo Orfila, accused of taking Ortega-Gutierrez from where he was residing at a shopping plaza and subsequently beating him at an illegal dumping site which was outside their jurisdiction.
Despite the testimony and emotional appeals from Otano's family, including a plea from his wife during the hearing who said through a Spanish interpreter, "Please let him come home to me and my baby," Judge Andrea Wolfson enforced a stern sentence, after denying a "motion of downward departure" requested by Otano's attorneys, stating her commitment to her heart and the law, Otano seemed remorseful merely for his apprehension, not his actions "That desire to terrorize this victim was so great, and then there were the cover-ups" Judge Wolfson said, as reported by Local10.
While Otano's attorney, Estefan López, has indicated plans to appeal the ruling, citing a lack of evidence and a conviction for a crime he claims Otano could not have committed—the family remains hopeful, with Otano's mother asserting to NBC 6's sister station Telemundo 51, "When you get out, you're going to show the world that you're innocent." Nevertheless, Miami-Dade State Attorney Katherine Fernandez Rundle has remarked on the gravity of the case stating, “Our police officers, who spend every day protecting our community, all understand that one cannot uphold the values of our laws while engaged in actions which violate the law itself”.
