
The quest for justice continues for the family of Devonte Dewayne Brown, who was fatally shot by a Cobb County police officer in 2021, as they have officially filed a lawsuit against the officer involved, Ian McConnell. According to FOX 5 Atlanta, this legal action comes in the wake of a grand jury's decision that found "no grounds for charges against the officers involved" in the incident that unfolded on August 18, 2021, when Brown was purportedly driving recklessly and subsequently resisted police efforts to apprehend him.
The altercation escalated to the point where Brown's vehicle was cornered and airbags were deployed, yet Officer McConnell discharged his weapon multiple times at the car despite other officers choosing not to shoot, a particularity that was brought to light by the family's attorney, Harry Daniels, in a video provided to the media him saying "There were other officers standing around that chose not to discharge their weapon, but this particular officer, for some odd reason, decided to use force, force that we believe was unlawful and excessive," as stated in an interview obtained by FOX 5 Atlanta.
The lawsuit emerges amidst assertions by the family's legal representation that the Cobb County District Attorney's Office did not present complete evidence to the grand jury, allegations that pointed to evidence assembled by the Georgia Bureau of Investigation (GBI) being handed over to the DA's office a whole nine months post the grand jury's review of the incident, as per information obtained by Atlanta News First.
Despite the fact that a gun was found in Brown's car, family attorneys hold that at the time of the shooting Brown posed no threat as he was already immobilized by his car's triggered airbags though in the moment of heated confrontation the officer involved shouted at Brown to raise his hands before firing several rounds into his vehicle which ended with Brown dying from multiple gunshot wounds, a grim sequence captured on video and released by the police, while District Attorney Flynn Broady has stated his office received the GBI investigation records in January 2022 and delayed presenting them to the jury until December, details that were provided in a statement obtained by Atlanta News First.
With the spotlight now on the Georgie Attorney General to appoint a special prosecutor, the unpacking of this case proceeds, fuelled by the family's determination and the community's anticipation for accountability and clarity. The family's attorneys have pushed for the release of the grand jury transcripts and reiterated their plea in front of the Cobb County Courthouse in Marietta, seeking to reassess the circumstances which led to the tragic end of Brown's life.
