According to a Facebook post by Constable Mark Herman's Office, the deputies conducted a traffic stop that led to the discovery of Garcia's inebriated state. After failing a series of Standardized Field Sobriety Tests, Garcia's previous record surfaced, revealing a prior conviction for the same offense. Herman's statement disclosed the arrest with a critical, yet understated tone, reflecting the gravity, of a second offense.

"Cruz Garcia was arrested and booked into the Harris County Jail, charged with Driving While Intoxicated- 2nd Offense," Herman stated. Notably, the court proved intent on setting an example, setting Garcia's bond at a solid $1,500.00 out of County Court 1.
