A Seattle police officer will not be criminally charged in the death of a young pedestrian, as per King County prosecutors' announcement. Officer Kevin Dave, involved in the fatal collision with 23-year-old Jaahnavi Kandula, a Northeastern University grad student, remains uncharged after an extensive review of the case. The tragedy unfolded on January 23, 2023, when Dave, while en route to an emergency call, struck Kandula as she crossed a South Lake Union intersection.
According to The Seattle Times, King County Prosecuting Attorney Leesa Manion stated, "After staffing this case with senior deputy prosecuting attorneys and office leadership, I have determined that we lack sufficient evidence under Washington state law to prove a criminal case beyond a reasonable doubt." The investigation findings have been conveyed to Kandula's family, who, along with the international community, have been shaken by her untimely death.
The fatal incident occurred as Dave was speeding at 74 mph in a 25 mph zone, responding to a high-priority overdose call. The Stranger reports that Dave's lights were activated, yet he only used his siren a fraction before the collision. Investigators believed that had Dave has been driving at 50 mph instead, he might have avoided the accident that propelled Kandula an estimated 138 feet from the point of impact.
In a disturbing twist, Officer Daniel Auderer of the Seattle Police Officers Guild was recorded making insensitive remarks about the victim, referring to her life having "limited value," which has been publicly condemned. Despite the deplorable comments, the focus remains on the incident involving Officer Dave. In a statement obtained by FOX 13 Seattle, Manion explained, "As egregious as Officer Auderer’s comments are, they do not change the PAO’s legal analysis into the conduct of Officer Dave." Auderer has since been removed from patrol and reassigned. Officials from India and Seattle's East Asian community have expressed outrage, demanding accountability and an in-depth probe into the grievous incident. The Office of Police Accountability is expected to continue its disciplinary investigation.
