An Atlanta judge found Dr. Jackson Gates and Gates Rapid Diagnostic Laboratory liable for posting graphic content of a decapitated baby's autopsy on social media. Twenty-year-old mother Jessica Ross and her partner Treveon Taylor Sr. filed the lawsuit following the horrific birth-related incident in July 2023, which resulted in the death of their child, reported by FOX 5 Atlanta.

The judgment by Fulton County Judge Jane Morrison comes after the baby, delivered at Prime Healthcare Service, Inc. d/b/a Southern Regional Medical Center, suffered fatal shoulder dystocia during delivery leading to a disjoined delivery where the body and legs were delivered in a STAT Cesarean section at one time, the baby's head delivered vaginally at another time, according to Atlanta News First. Dr. Tracey St. Julian, M.D., struggled to deliver the child before deciding on the surgical procedure, the delivery culminating tragically with the death and subsequent decapitation of the newborn.

In their emotionally heavy battle for justice, the couple also contends with the unwanted online exposure of their child, allowed by the actions of Dr. Gates who took $2,500 to perform an autopsy and then posted a full-face picture and videos of the baby's organs on Instagram, without the family's consent, their deep sense of invasion detailed in their accusations and interviews obtained by FOX 5 Atlanta and Atlanta News First.

Despite the backlash and legal pressure, Dr. Gates defended his actions, stating that his intention was not to exploit, but to educate asserting that he never divulges the identity of patients, living or deceased; he responded, "I want you to hear this clearly, I will never divulge the identity or disclose the identity of any live patients or any deceased patients that come for my care," in a self-recorded video response posted to Instagram, as reported by FOX 5 Atlanta.

The case, which sheds light on the fragility of patient privacy in the digital age and the sanctity of medical ethics, awaits determination of damages for the bereaved parents. Meanwhile, the Clayton County Medical Examiner’s Office has ruled the baby’s death a homicide, intensifying the gravity surrounding the case as further investigations continue.
