The plaintiff, Denton E. Loudermill Jr., is reported to have filed his lawsuit in U.S. District Court in Kansas, where he is notably seeking redress for the harm caused by the Congressman's erroneous social media actions. On the day of the Chief's celebration, Loudermill had been present, and a subsequent shooting violently erupted, turning festivities into a scene of tragedy. The incident left one person dead and over 20 injured, prompting Burchett to seemingly quickly post the identity of what he wrongly claimed was a suspect. Post the chaotic sequence of events, the Congressman had posted pictures of Loudermill on X, the social media platform previously recognized as Twitter, allegedly tagging him as the shooter.
