In Phoenix, Arizona, a legal fiasco has unfolded after 66-year-old Penny McCarthy was erroneously taken into custody by U.S. Marshals under the guise that she was a fugitive named Carole Anne Rozak with a history of non-violent offenses, ABC15 reported. McCarthy found herself in the throes of a nightmarish scenario when officers, clad in ballistic vests and brandishing weapons, arrested her outside her residence, despite her insistence on being misidentified.
According to McCarthy's testimony obtained by ABC15, the false arrest was the culmination of a bewildering mix-up; she was shackled and transported to federal prison on a supposed parole violation warrant from 1999, stemming from Oklahoma, a state she claims to have never lived in. McCarthy and her relatives, reeling from the event, have since called for an explanation and reparation for what transpired while maintaining that a serious administrative error is at fault.
The case thickened when McCarthy's original identity hearing was canceled after the U.S. Attorney's Office filed a motion to dismiss the case, as per ABC15 reports. The reason cited was that continuing would not serve the interests of justice. Despite this reversal, McCarthy has expressed her dissatisfaction, stating, "This says we screwed up and we’re going to make this go away. And I’m supposed to just lay down and play dead, and I’m not going to do it."
McCarthy reported having to go through the indignity of multiple strip searches and other humiliations during her time behind bars, experiences she mentioned as "scary as hell." Her demands after the ordeal include wanting "my life back. I want my DNA in my possession. I want my mug shots that they took in my possession," McCarthy told ABC15. The U.S. Marshal's Service has acknowledged the arrest but offered no comment on the mistaken identity claim due to ongoing proceedings.
